Filing Deadline – Campaign Law

TO CLIENTS AND INTERESTED PERSONS:

A filing deadline for certain reports required by the California Political Reform Act is coming up. The deadline is October 31, 2013, with a cutoff date of September 30, 2013. This deadline is applicable to the following filings:

 1. Major Donor Committee Form 461:

A major donor is any person or entity that contributes $10,000 or more in a calendar year to candidate and ballot measure committees. A special odd-year quarterly report is due on 10/10/13 if a major donor both has reached this threshold and has contributed $10,000 or more to state officeholders, their controlled committees, or committees primarily formed to support or oppose any state officeholder during the period 1/01/13 through 9/30/13. Controlled committees include ballot measure committees controlled by a statewide officeholder.

 2. Independent Expenditure Committee Form 461:

An independent expenditure committee is any person or entity that spends $1,000 or more of their own funds on expenditures that expressly advocate the election or defeat of any candidate or measure on the election ballot without coordinating, consulting with, communicating with, or acting in concert with a candidate or measure. An independent expenditure committee can also make contributions directly to candidates or measures. A special odd-year quarterly report is due on 10/31/13 if an independent expenditure committee contributed $10,000 or more to state officeholders or committees primarily formed to support or oppose any state officeholder during the period 1/1/13 through 9/30/13. Controlled committees include ballot measure committees controlled by a statewide officeholder.

 3. General Purpose Recipient Committees: A general purpose recipient committee is a committee that has received $1,000 or more for political purposes and is registered with the Secretary of State’s office. A special odd-year quarterly report is due on 10/31/13 if a general purpose recipient committee has contributed $10,000 or more to state officeholders, their controlled committees, or committees primarily formed to support or oppose any state officeholder during the period 1/1/13 through 9/30/13. Controlled committees include ballot measure committees controlled by a statewide officeholder.

 4. Primarily Formed Ballot Measure Qualification Committees:

A committee that receives contributions of $1,000 or more from other sources and whose purpose is to support the qualification of a measure for the ballot must file a quarterly Form 460 for each calendar quarter until the measure will be voted upon. Such committees must file the Form 460 irrespective of the amount of money raised or spent during the quarter. A quarterly Form 460 for such a committee must be filed by 10/31/13 for the period 1/1/13 through 9/30/13.

 5. Lobbying Forms 635 and 645:

Any person or entity that employs a lobbyist must file a quarterly Form 635. Any person or entity that spends $5,000 or more for lobbying related activities must file a quarterly Form 645. These reports must be filed by 10/31/13 for the period 1/1/13 through 9/30/13.
